Site C challenge denied by B.C. Supreme Court

A petition by two B.C. First Nations to halt construction of the Site C dam (2016 Top100 Project #2) in northeastern B.C. has been rejected by the province’s top court.

According to a CBC news article, the West Moberly and Prophet River First Nations argued that they were not properly consulted on the permitting for the project, which will flood thousands of acres of their traditional lands.

Justice Robert Sewell disagreed with the claim, stating that the province did attempt to engage the communities and, on more than one occasion, it was First Nations representatives who failed to show up to scheduled consultations.

This is the first of four legal challenges that the two First Nations communities have filed against the construction of the Site C project.
